I am a Santa Barbara family law attorney who can help with a variety of family law issues, including:

  • Marital Dissolution: California is a "no-fault" state, meaning a divorce can be granted based simply on "irreconcilable differences," even if one spouse objects. It also means infidelity or other undesirable conduct cannot be considered in the overall division of assets or a spousal support award.
  • Legal Separation: Some couples choose this alternative as a way to conclude property and support issues, without dissolving the marriage perhaps because of religious beliefs, or a need to remain on a spouse’s medical insurance.
  • Child Custody & Visitation: Your family is my top priority. It is usually in a child’s best interests to have frequent and continuing contact with both parents. Thus, even if a child does not spend equal time in each parent’s home, it is important for the child to have regular access to both parents.
  • Child Support: Both parents have a legal duty to provide financial support for their child. The amount is based on each parent’s income, and the amount of time the child spends with each parent. CA Courts utilize a computerized algebraic formula to calculate child support. The Court may also order parents to share equally in the cost of childcare and uncovered medical expenses.
  • Spousal Support: CA Courts have broad discretion to order one spouse to pay support to the other, and to determine the duration and amount of support. Thus, it is critical that you retain an attorney who takes sufficient time to understand your financial circumstances, and makes a compelling argument on your behalf.
  • Guardianships: This is a legal process where a person other than a parent is given authority over and custody of a child, or a child’s property. Significantly, parental rights are not terminated, affording a drug-addicted or alcoholic parent an opportunity to get their life back on track.
  • Grandparents’ Rights: Grandparents often play many roles in a family. They can offer stability, emotional support and comfort, and impart family history. A Court has discretion to determine if grandparent visitation is in the best interests of a child.
  • Domestic Violence: There is a legal presumption that a parent who has been adjudicated guilty of domestic violence is an unfit parent. Since that will negatively impact custody rights, that parent should seek competent legal advice. Similarly, a party who believes they have been wrongfully accused of domestic violence should seek the advice of an attorney with experience in this area of law. In appropriate cases, the courts may issue permanent (3-5 year) restraining orders, and may order the abuser to vacate the family residence, whilst continuing to pay the mortgage or other community debts.

Divorce is a vulnerable time for the separating couple.
